Certified Tutors LLC - Ireland

These Terms & Conditions (“Terms”) govern the use of Certified Tutors’ services by Tutors, Students, and Families. By accessing our website, registering as a Tutor, or booking tutoring services, you agree to be bound by these Terms.

1. Definitions

  • “Company” / “Certified Tutors” means Certified Tutors, provider of the tutoring platform.

  • “Tutor” means an independent contractor who provides tutoring services through Certified Tutors.

  • “Student” refers to learners aged 18 or over.

  • “Family” refers to the parent or guardian of any learner under the age of 18.

  • “Client” means Students and/or Families engaging tutoring services.

 

 

2. VAT Status

2.1 All tutoring services provided by Certified Tutors are exempt from VAT under Irish law.
2.2 Clients pay only the agreed session fee; no VAT is added.

 

 

3. Independent Contractor Status (Tutors)

3.1 Tutors are engaged as independent, self-employed contractors, not as employees, workers, or partners of the Company.
3.2 Tutors are solely responsible for declaring and paying their own taxes, PRSI, USC, and other charges.
3.3 Certified Tutors does not deduct income tax or other statutory charges.

 

 

4. Payments

4.1 Families must pay Certified Tutors in advance of tutoring sessions.
4.2 The Company deducts its commission (up to 25%) and transfers the balance to the Tutor once cleared funds are received.
4.3 Lesson fees are payable in euro.
4.4 Tutors must provide accurate bank details; Certified Tutors is not responsible for misdirected payments caused by incorrect information.

 

 

5. Self-Billing (Tutors)

5.1 Tutors authorise Certified Tutors to issue invoices on their behalf (“self-billing”).
5.2 Invoices will detail the Tutor’s name, address, services provided, and net amount payable after commission.
5.3 Tutors must notify Certified Tutors of changes to their details.
5.4 Tutors remain fully responsible for tax compliance.

 

 

6. Operation & Access

6.1 Certified Tutors may, for legal, commercial, or operational reasons, withdraw, suspend, or modify any part of its services.
6.2 The website may occasionally be inaccessible due to technical issues; reasonable efforts will be made to restore access promptly.

 

 

7. Conduct & Professionalism

7.1 Tutors must:

  • Maintain professional behaviour at all times,

  • Arrive punctually and be prepared for lessons,

  • Communicate respectfully with students, families, and the Company,

  • Notify clients and Certified Tutors of delays or cancellations.
7.2 Tutors agree to offer a complimentary 15-minute introductory phone call for new families, if requested, prior to lessons beginning.
7.3 All sessions must be booked and recorded using Certified Tutors’ designated systems.
7.4 Lessons may only be arranged with the consent of the student or their guardian.
7.5 Tutors and Clients must not solicit, approach, or attempt to bypass Certified Tutors by engaging directly with one another outside the platform.

  • For Tutors, this restriction applies for 24 months after the last session.

  • For Students/Families, this restriction applies for 9 months after the last session.

 

 

8. Academic Honesty

8.1 Tutors must not complete coursework, assignments, or examinations on behalf of students. Support is limited to explanation, guidance, and practice.

 

 

9. Confidentiality

9.1 Tutors agree not to disclose or misuse any personal information relating to students or families.
9.2 Certified Tutors may use anonymised data for statistical purposes and may share aggregated results with third parties.

 

 

10. Eligibility & Consent

10.1 Students must be at least 18 years old to book a tutor for themselves.
10.2 Learners under 18 must be represented by a parent or legal guardian, who must give consent for tuition.
10.3 Certified Tutors is not responsible for disputes between under-18 students and their parents/guardians.

 

 

11. Introductory Calls & Bookings

11.1 Students may request a complimentary phone call (up to 15 minutes) with a tutor prior to purchasing lessons.
11.2 To confirm bookings, valid payment details must be entered and packages must be paid for in advance.
11.3 When a booking is confirmed, the student enters into a direct contract with the tutor for provision of lessons. Certified Tutors accepts no liability for the tutor’s teaching methods or conduct.
11.4 For in-person tuition, clients must provide accurate address details and a suitable learning environment.

 

 

12. Cancellations & Missed Lessons

12.1 Student cancellations:

  • Cancel 8+ hours before → no charge.

  • Cancel <8 hours before → up to 50% of the fee may be charged, at the Tutor’s discretion.

  • No cancellations allowed after the lesson has started.
12.2 Tutor cancellations:

  • Tutors must inform the student and the Company as early as possible.

  • If a tutor cancels, no fee is charged and any pre-payment will be refunded in full.
12.3 Missed lessons:

  • If a student fails to attend, they may be charged up to 50% of the fee, subject to the Tutor and Company’s discretion.

 

 

13. Complaints

13.1 A “Complaint” means a refund request arising from:

  • a missed lesson (tutor did not attend), or

  • unsatisfactory service quality.
13.2 Complaints must be submitted by email within 48 hours of the lesson’s scheduled end.
13.3 Tutors will be notified and may dispute within 48 hours.
13.4 If undisputed, Certified Tutors will process a full refund of the tutor’s fee.
13.5 If disputed, the matter may be resolved directly between student and tutor.
13.6 Certified Tutors may, at its sole discretion, issue goodwill refunds.
13.7 Repeated complaints may trigger monitoring of lessons.

 

 

14. Liability

14.1 Certified Tutors accepts no liability for any direct, indirect, or consequential loss, including financial or data loss, arising from use of the website or services.
14.2 Certified Tutors does not guarantee that the website is free from viruses or harmful components.
14.3 Certified Tutors is responsible only for its own actions, not those of tutors or students.

 

 

15. Termination

15.1 Certified Tutors may suspend or terminate a tutor’s or student’s access if they fail to comply with these Terms.
15.2 Certified Tutors reserves the right to cancel bookings in such circumstances.
15.3 Tutors may terminate their relationship with Certified Tutors with two (2) weeks’ written notice.
15.4 Students may cease using the services at any time, subject to payment of outstanding fees.

 

 

16. Statutory Rights

16.1 Nothing in these Terms affects statutory rights under Irish law.

 

 

17. Governing Law

17.1 These Terms are governed by and construed in accordance with the laws of Ireland.
