By registering, you accept that you are entering into a contract with us based on these Terms and Conditions. Visitors to the Certified Tutor service who do not register similarly affirm that they are bound by these Terms and Conditions each time they access the Certified tutors website. We may share these terms and conditions from time to time.
Hereafter, all references to “Student” refers to students above the age of 18 or their parent and/or guardian for students under the age of 18.
Certified Tutors:

The Certified Tutors website is owned and operated by Certified Tutors LLC, a limited liability company registered in Sharjah Media City, Sharjah, UAE under company number 2323048. The Certified Tutors registered office is at Sharjah Media City, Free Zone Authority, Sharjah, UAE.

By using our website, the user agrees to be bound by these terms and conditions. These terms and conditions are legally binding – every user should read them fully before agreeing to them. (Please print or save these terms for future use as Certified Tutors will not keep a file copy specifically for the user and Certified Tutors cannot guarantee that they will remain accessible on the website in the future.) If a user does not wish to be bound by these terms, they should not use the website.

The Website has been established to provide a personalized service to match students and tutors.

Certified Tutors will take all reasonable precautions to keep the details of Tutors and Students secure but will not be liable for unauthorized access to the information provided by Tutors and Students.

In case of user interaction with the website, Certified Tutors hold the right to collect non-personal information. This may consist of information regarding the computer type, browser name, and technical data regarding Users’ resource for connection to our Website, with the likes of the Internet Service Providers, operating system, amongst other significant information.

Certified Tutors do not guarantee to secure a Tutor for a Student or vice versa.

Operation of Certified Tutors services: Certified Tutors reserves the right to withdraw or modify aspects of the Certified Tutors service, or the entirety of it, where we have legal or commercial reasons to do so. There may also be times when the Certified Tutors service becomes inaccessible as a result of technical difficulties experienced by Certified Tutors or on the internet; we will, however, use reasonable skill and care to overcome these difficulties where they are within our control.
Tutors:

A Tutor who resides in the UAE must be legally entitled to work in the UAE and have their own visa.

A Tutor who resides outside the UAE is responsible for the declaration of taxes in their own country of residence or for tax paying purposes.

A Tutor warrants that they are at least eighteen years of age, have the necessary qualifications and/or experience to provide tuition in the subjects specified by the Tutor.

A Tutor warrants that they will abide by all local laws in UAE (or their country of residence) and terms of their employment contract (if applicable) before taking up any tutoring jobs.

A Tutor acknowledges that they are not an employee of Certified Tutors and accepts full responsibility for all Income Tax and other liabilities payable in relation to any fees generated from a tuition contract. Certified Tutors does not employ any tutor on their role and our services are like any other classified tutor website platforms. Tutors are solely responsible for their actions both on and off the website.

A Tutor shall indemnify Certified Tutors from all claim liabilities, costs and expenses (actual or consequential) of every kind and nature known and unknown, suspected and unsuspected disclosed and undisclosed arising out of any use by the Tutor of the Website.

A Tutor hereby acknowledges that Certified Tutors are not liable to the Tutor for reimbursement of any fees paid pursuant to these Terms in the events of any cancellation of any Contract or Tuition for any reason.

A Tutor undertakes to register for the Certified Tutors service using accurate and current information about themselves - including their correct name, address, telephone number, qualifications and any other requested details. This information must be updated regularly to maintain its accuracy.

A Tutor must disclose any criminal convictions or cautions they may have to Certified Tutors, including any criminal convictions or cautions received at any time after having registered a tutor account on the website and for as long as the tutor remains registered.

Any tutor who, in Certified Tutors opinion, fails to comply with these terms and conditions may be immediately barred from using the website and related services. Certified Tutors reserves the right to cancel any existing bookings at any time in such circumstances.

A Tutor must use their own judgment about whether they wish to offer their tuition services to each student. A Tutor must take every precaution to ensure that they work in a safe environment and are responsible for maintaining their own insurance policies to cover the work they undertake.

A Tutor should make bookings for lessons and respond to messages received from Certified Tutors and users promptly.

Tutors agree to offer a complimentary trial lesson of 30 minutes to students for the purpose of initial assessments and getting to know the student and family.

For any meetings (including lessons, trials, or assessing student need) with a student found via Certified Tutors, a Tutor must make a booking to account for this time using Google Calendar. A Tutor agrees not to solicit students or disintermediate Certified Tutors or attempt to solicit students or disintermediate Certified Tutors, in any way, by booking a lesson with any student associated with Certified Tutors, within twenty-four months from the date of the most recent booking with the relevant student (the Tutor Restriction Period).

A Tutor must only make bookings for lessons through Certified Tutors following the instructions of the parents, guardians or students (if older than 18).

Academic Honesty: A Tutor must not complete or intend to complete coursework, or any similar assignments, on behalf of students.

A Tutor is responsible for ensuring that they have the correct lesson location and are at the lesson location ready to teach at the agreed time as booked on the website. A Tutor who is late for a lesson must provide evidence that they contacted the student directly to make them aware of their lateness and that the student was happy to take the lesson at a later time. Any tutor who fails to do so will be liable to refund the student any tutor fee they have received for the relevant booking.
Students
All references to “Student” refers to students above the age of 18 or their parent and/or guardian for students under the age of 18. ​

Students acknowledge that Certified Tutors may use data for statistical analysis and may provide this to interested third parties.

Students warrant that their e-mail and other contact addresses are valid and will be up to date when using the Website.

Students agree not to impersonate any other person or entity or to use a false name or a name that they have no authority to use.

Students acknowledge that Certified Tutors are not liable for direct or indirect consequential or any other form of loss or damage that may be suffered by a user through the use of the Website including loss of data or information or any kind of financial or physical loss or damage.

Students acknowledge that Certified Tutors give no guarantee that the website is free of viruses, worms or any other form of harmful components.

Certified Tutors is not responsible for the acts or omissions of students or tutors and is solely responsible for its acts or omissions of itself.

Students must be at least 18 years old to request a tutor for themselves. Students under the age of 18 must be represented by a parent or legal guardian who gives consent for them to receive tuition from a tutor via Certified Tutors. Certified Tutors is not responsible for any dispute between a person under the age of 18 and a parent or guardian.

Students are entitled to a trial lesson, up to 30-minutes, with a Tutor recommended by Certified Tutors prior to purchasing a package of lessons.

To confirm any further bookings with a tutor, the student must enter, or have already entered, valid payment details on the website and paid for a package.

When a booking is confirmed, the student enters into a direct contract with the tutor for the provision of lessons and Certified Tutors accepts no liability concerning the tutor's provision of lessons.

Students agree not to circumvent or disintermediate, or attempt to circumvent or disintermediate, Certified Tutors in any way at the time of booking any tutor, during any period of confirmed bookings with any tutor or at any time within nine months of the date of the most recent booking with the relevant tutor.

In the circumstance of in-person home tuition, students must ensure that they have given enough information to the tutor, including their correct address, to allow the lesson to take place. If a lesson is to take place at the student's home, the student must provide a suitable setting for tuition.

Any student who fails, in Certified Tutors’ reasonable opinion, to comply with these terms and conditions may be immediately barred from using the website and any related services. Certified Tutors reserves the right to cancel any existing bookings in such circumstances.

Cancellations: students or families may cancel any booking, without incurring any charge, by giving more than 8 hours' notice to the Tutor. See details about cancellations in the Section titled “Cancellations” below.

Nothing in these terms and conditions affects a student's statutory rights.

Simply by agreeing to these terms and conditions, a student is not required to sign up with any tutor or make any bookings.

Subject to paying for any bookings used, a student may cease to use the Certified Tutors service at any time.
Payments

For students the lesson fee is a combination of the tutor's price and commission fees. The commission fee will be collected by Certified Tutors as a provider of the site services. All fees shall be payable in AED.

The lesson fee will be determined by the provider based on their assessment of the duration and type of service being provided. (Certified Tutors reserve the right to adjust or increase the commission fee from time to time).

Certified Tutors will receive up to 25% of the payment towards commission fees, payment fees and other fees required for the running of the website.

The student agrees to purchase a monthly package of lessons before their sessions begin. Payments will be released to the Tutor on a bi-weekly basis.

If any student or parent makes a complaint (claiming for a missed lesson or raising a refund request), charges may nevertheless be processed as usual to collect a payment, and refunded as appropriate, following these terms and conditions and investigation by the Certified Tutors team.

If a lesson does not take place because a student does not attend (whether in person or online), the student will be charged half the lesson fee, at the discretion of the Tutor and Certified Tutors Company.

Tutors are responsible for providing the correct payment information when requested. Any error in IBAN or account details could result in payments being sent to the wrong account. Certified Tutors will not be liable for such errors.
Cancellations

A student may cancel a booking at any point before the scheduled start time of a lesson.
-
A student may cancel a lesson by contacting the tutor and the tutor is then responsible for canceling the booking on the website.
-
Cancellations made 8 or more hours before a lesson is due to commence will incur no charge.

Bookings canceled by a student less than 12 hours before a lesson is due to commence may incur a charge. Certified Tutors leaves it to the tutor's discretion whether to accept the cancellation request and not charge any lesson fee or to charge the student half the lesson fee, as displayed at the time of confirming their booking. Unless instructed otherwise by the tutor, Certified Tutors will, as the tutor's agent, automatically charge half the lesson fee and payment will be processed following these terms and conditions.

Tutors may cancel a booking at any time before a lesson takes place. To do so, tutors must inform the student directly and cancel the booking on the website. In the event of a tutor canceling a booking, the student will not be charged any lesson fee or, if the student has paid the lesson fee, will receive a full refund.

Bookings cannot be canceled after the lesson has started.
Missed lessons and Complaints

As defined at the end of these terms and conditions, a "Complaint" covers any cause for the student to seek a refund as a result of the service provided by the tutor, including, but not limited to, a missed lesson (where the tutor did not attend a lesson booked on the website) or a claim about quality (where the student feels that the service provided by a tutor falls below the standards they reasonably expected).

A student should inform Certified Tutors of a Complaint by email within 48 hours after the scheduled finish time of the relevant lesson.

When a complaint has been received from a student, Certified Tutors will contact the tutor within 48 hours of the complaint being received, by email and text message to inform the tutor that a complaint has been raised.

Should a student inform Certified Tutors of a complaint within 48 hours after the scheduled finish time of the relevant lesson, the tutor has 48 hours to inform Certified Tutors through the website of their desire to dispute the complaint (and reject the associated refund request). Should the tutor not dispute the complaint through the website within 48 hours of being notified of the complaint, Certified Tutors, as the agent of the tutor, will process a full refund to the student of the tutor Fee. Certified Tutors will promptly inform the student of the tutor's decision whether or not to uphold their complaint by email and, if upheld, authorize the associated refund.

Should the student and tutor not reach an amicable agreement regarding a complaint, the student is entitled to make a claim against the tutor in relation to the complaint. As set out in clause 11, Certified Tutor accepts no liability concerning complaints and the services provided by a tutor.

Certified Tutors reserves the right to offer any student, as a gesture of goodwill, payment of a sum equivalent to the full lesson Fee. Such a payment will be awarded solely at Certified Tutors' discretion.

In the event of more than one complaint, Certified Tutors will observe the next session taking place and ensure that quality teaching is occurring.
